June 2008 - Fourty Fourth Meeting
- The
Minutes and Resolutions of the previous meeting were approved.
- It
was reported that there were 166 victims of vCJD as at 2 June
2008, according to the figures on the National CJD Surveillance
Unit website. However Charles Russell were aware of 172 victims.
Main Applications had been received in relation to 169 claims.
By the end of this meeting, the Trustees had considered 167 of
the claims submitted to date. The Trustees had considered a total
of 364 claims for £5,000 Psychiatric Injury, 196 claims
for Particular Emotional Hardship and 37 claims for Particular
Financial Hardship.
- The
meeting included consideration of five claims by family members
of four victims for the single sum of £5,000 for psychiatric
injury lasting longer than a calendar month that has been caused
or materially aggravated by the fact that the victim has contracted
vCJD and five new claims in relation to four victims for Particular
Emotional Hardship. There was one new claim for Particular Financial
Hardship and no claims for Carer's or Victim's Loss of Earnings.
- 37.6m
had been paid in compensation to date. £10.56m had been
paid for costs and expenses, which includes £4.73 million
in relation to Charles Russell's fees (inc VAT) and £3.45
million in relation to Irwin Mitchell's fees (inc VAT).
- The
Trustees resolved to propose a revised amendment of the Scheme
to the Department of Health in the event that the Department would
not agree to the radical amendments that had been proposed previously.
- The
Trustees agreed an alternative method for approving 'Living Trusts'
for newly diagnosed Victims in light of the impact of the Mental
Capacity Act 2005.
- The
Trustees noted that there had been a limited response from applicants
for the role of Nursing Trustee to replace Vicky Vidler and they
agreed that advertisements should be placed in the Nursing Times
inviting applications for the position.
