It was agreed that there was no agreement between the representatives
of the families and the Department of Health in relation to mileage
and care.

- Mileage
at 21 pence per mile was accepted to be appropriate by reference
to the Professional Negligence Bar Association Tables for damages.

- Sir
Robert Owen agreed to reconsider the ceiling at Stage 2 of care
at the next Trustees' meeting. The possibility of Irwin Mitchell
being sent the Recommendations before these are submitted to the
Trustees would also be raised.

Two

- Sir
Robert Owen, David Body, Richard Vallance, Jennifer Jack and Edwina
Rawson were present for this part of the meeting. Counsel for
the families and Department of Health were not required to stay.

- The
problems of omissions and inconsistencies in the presentation
of the claims was discussed. Specific examples included the difficulty
of identifying who provided care, the references to possible applicants
who do not appear to be represented by Irwin Mitchell, and the
increase in the number of hours claimed for care in the revised
schedules. It was explained that these problems have made it difficult
to decide claims and have caused delay.
