March 2005 - Twenty Sixth Meeting
- The
Minutes and Resolutions of the previous meeting were approved.

- It
was reported that there were 154 victims of vCJD as at 5 April
2005, according to the Department of Health's website. Main
Applications had been received in relation to 148 victims. By
the end of this meeting, the Trustees will have considered 143
claims on the claims submitted to date. The Trustees had considered
a total of 233 claims for £5,000 for psychiatric injury.

- £29.6m
had been paid in compensation to date. £6.5m had been
paid for costs and expenses.

- The
Trustees considered the possibility for overlap between the
claims to the Discretionary Fund. For example, if loss of earnings
are claimed as a result of financial hardship caused by a psychiatric
injury, then this should not duplicate any claim put forward
by the same person for Carer's Loss of Earnings. The point would
be reconsidered in due course

- The
final draft of the website was considered and approved. This
will go live as soon as possibl

- A
psychiatrist's fees for preparing reports was approved.

In
relation to clause 4.3.2, a psychiatric condition giving rise
to particular financial and emotional hardship, the Trustees
reconsidered the principles and procedure that had been adopted
previously. A letter would be sent to the families providing
details of the decisions in due course.

The
Trustees considered 2 new cases, 2 claims with outstanding issues,
and 8 claims in relation to 5 victims for the single sum of
£5,000 for psychiatric injury lasting longer than a calendar
month that has been caused or materially aggravated by the fact
that the victim has contracted vCJD.
